Introduction
The ponuz.com platform is owned by the holders of the Ponuz trademark, with the contact address contact@ponuz.com. By using this website and Ponuz software, you agree to these Terms and Conditions of Use. If you do not agree, please refrain from using this site or service.
Ponuz (hereinafter "the platform" or "the service") was created to provide artificial intelligence software as a Service (SaaS), offering functionalities for business organization, task management, collaboration, and efficiency improvement through web-based access.
Some features of the service include:
An AI-powered chat that can store and recall certain information provided by the user.
A Dashboard featuring charts, metrics, and the ability to upload documents that the AI can use as context for its responses.
A Collab section for group and private chats between collaborators, where you can also invoke the AI.
A Settings section to modify user data, delete conversations, manage AI memory, and handle subscriptions and collaborator permissions.
1. Definitions
- Client/User:
Any individual or company that uses or subscribes to the service and thus accesses the platform. This includes visitors (limited access) and users with active plans (full access to the available features).
- Third Parties:
External providers and services used by the platform for specific functions (Auth0, Stripe, OpenAI, xAI, Pinecone, Vercel, Heroku, among others). Ponuz does not have direct control over the data processing carried out by these third parties.
- Website:
Refers to ponuz.com, where services, content, payment gateways, and information about available plans are displayed.
- Dashboard:
An interactive panel accessible to Clients/Users through their username and password, featuring analytics tools, charts, and document management functions.
- Plans:
The various subscription options (monthly, annual, or other billing periods) offered with specific features and prices.
2. Terms of Access and Use
The User agrees to:
- Use the platform for lawful purposes and in compliance with moral standards, good customs, and public order.
- Refrain from any conduct that might damage, disable, or compromise the services, content, or infrastructure of the platform.
- Not reproduce, copy, distribute, or modify the platform without the express authorization of Ponuz.
- Not publish threatening, offensive, slanderous, obscene, pornographic, or otherwise unlawful content.
Ponuz uses APIs and third-party services to deliver the announced functionalities. Therefore, in the event of failures or interruptions caused by these external services, Ponuz will take all reasonably possible measures; however, the User acknowledges that certain factors lie beyond Ponuz's control.
3. Disclaimer of Liability
Ponuz does not guarantee the accuracy or veracity of the information generated by the AI; as a generative system, it may contain errors, omissions, or interpretations depending on how users interact with it.
The content the user shares or stores on the platform (e.g., corporate documents, collaborator data, etc.) is the exclusive responsibility of the user.
Ponuz accepts no liability for the presence of viruses, spyware, or any other harmful elements that could be introduced into the platform by third parties.
4. Intellectual Property
The platform, including its graphic elements, code, names, trademarks, designs, code integrations, and underlying functionalities, is protected by applicable intellectual property laws. The reproduction, modification, transmission, or distribution of these elements without express authorization is strictly prohibited.
5. Site Operation
Ponuz may carry out corrections, improvements, or modifications to the information contained on the site or within the platform's features without entitling users to any claim or compensation. Likewise, Ponuz is not liable for damages or harm arising from the availability and technical continuity of the website or the platform to the extent that such disruptions are due to causes beyond Ponuz's reasonable control.
6. User Data Protection
For details on Ponuz's privacy policy and how personal data is handled, please review the Privacy Notice, available in this document and on ponuz.com. Ponuz is committed to safeguarding user information in accordance with the Mexican Federal Law on Protection of Personal Data Held by Private Parties and all other applicable regulations in Mexico.
7. Refund Policy
Users who have subscribed to any Ponuz plan may request a 100% refund of their payment under the following conditions:
- The refund request must be made within the first 30 calendar days from the date of purchase.
- Send an email to contact@ponuz.com including the purchaser's details, proof of payment, the registered email address, and the reason for the refund request (the reason does not affect your right to a refund; it is only used for internal service improvement).
- Ponuz will not issue refunds to any individual who is not the holder of the payment method used.
- If an invoice was issued for the plan, the CFDI (electronic invoice) will be canceled using the appropriate cancellation code.
- The refund will be processed within 20 banking business days following the request. A confirmation will be sent to the registered email once completed. Any subsequent inquiries must be directed to your bank.
8. Governing Law and Jurisdiction
All matters related to the site and the User shall be governed by the laws of the United Mexican States, excluding any rule that might refer to the application of foreign law. Any dispute will be submitted to the competent courts of the city of León, Guanajuato, unless otherwise dictated by mandatory legal provisions.
